1. Acceptance of Terms
Welcome to the Yangzi Explorer website (”Website”). These Terms and Conditions (”Terms”) govern your use of this Website and any bookings you make with us. By accessing, browsing, or making a booking through this Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use this Website or make a booking.
2. Intellectual Property
All content on this Website, including but not limited to text, graphics, logos, images, digital downloads, data compilations, and software, is the exclusive property of Yangzi Explorer, Hubei Royal Yangzi Cruise Ltd. (”ORC”), or their content suppliers and is protected by international copyright and intellectual property laws. Any unauthorized reproduction, duplication, copying, sale, reselling, or exploitation of any portion of the Website is strictly prohibited.
3. Booking and Contract Formation
3.1. Invitation to Treat
The information and booking options presented on the Website constitute an invitation to treat. Your booking request is an offer.
3.2. Contract Formation
A binding contract is formed only upon our issuance of a written booking confirmation to you. The contract incorporates these Terms and the specific terms of the Cruise Ticket Contract, which will be issued upon or after final payment.
3.3. Pricing
All prices are quoted in US Dollars and are subject to change without notice until a booking is confirmed. The Passenger bears responsibility for all applicable fees, charges, duties, and taxes.
4. Payment Terms
4.1. Deposit
A non-refundable deposit of 20% of the total booking value is required within 14 days of booking to secure your reservation.
4.2. Final Payment
The remaining 80% of the total booking value must be paid no later than 60 days prior to the scheduled departure date. For reservations made within 60 days of departure, full payment is required at the time of booking.
4.3. Failure to Pay
Failure to make payments by the due dates will result in the automatic cancellation of your reservation, and all payments made shall be forfeited.
5. Cancellation by Passenger & Refunds
5.1. Cancellation Request
All cancellations must be made in writing to Yangzi Explorer. If you cancel your cruise, the following charges will apply, calculated from the date we receive your written notice. Please note that your initial deposit is non-refundable.
- 180 days or more prior to sailing: 10% of total cruise fare.
- 179 to 60 days prior to sailing: 20% of total cruise fare.
- 59 to 30 days prior to sailing: 50% of total cruise fare.
- 29 days or less prior to sailing: 100% of total cruise fare.
5.2. No Refunds for Unused Services
No refunds will be made for any unused portions of the cruise, including for premature departure or missed shore excursions, for any reason whatsoever.
6. Passenger Responsibilities
6.1. Travel Documentation
The Passenger bears sole responsibility for obtaining and maintaining all necessary travel documents, including passports, visas, and health certificates, as required for the itinerary.
6.2. Punctuality
Passengers must be onboard no later than 60 minutes before the scheduled sailing time. ORC is not liable for any passenger who fails to board on time and shall be under no obligation to delay the vessel’s departure. No refund will be provided, and ORC shall not be responsible for any resulting expenses.
6.3. Travel Insurance
Passengers are strongly advised to purchase comprehensive travel insurance, including coverage for trip cancellation, interruption, medical expenses, and baggage loss.
7. Limitations and Changes to Itinerary
7.1. Right to Deviate
ORC and the vessel’s captain reserve the right, at any time and without prior notice, to cancel, advance, postpone, or deviate from any scheduled sailing or port of call, or to substitute another vessel or port of call for any reason, including but not limited to acts of God, force majeure, weather, operational needs, or safety.
7.2. No Liability
In such events, while we will make reasonable efforts to provide an equivalent experience, ORC shall not be liable for any loss whatsoever to passengers and is not obligated to provide any refund or compensation.
8. Limitation of Liability
8.1. Website Use
To the maximum extent permitted by law, Yangzi Explorer, ORC, and their affiliates shall not be liable for any damages arising from your use or inability to use the Website.
8.2. Cruise Services
ORC shall not be liable for any loss, damage, injury, or death unless directly caused by its proven negligence. ORC is not liable for the acts or omissions of independent contractors (e.g., shore excursion providers), who are not its agents, servants, or employees.
8.3. Property
ORC shall not be liable for loss of or damage to valuables or personal property unless deposited with the ship’s Front Desk for safekeeping and a receipt issued.
8.4. Governing Contract
Any claim related to the cruise service is governed by the Cruise Ticket Contract, which prevails over these Terms in the event of any conflict.
9. Indemnification
You agree to indemnify, defend, and hold harmless Yangzi Explorer, ORC, their affiliates, and their respective officers, directors, and employees from and against any and all claims arising from your breach of these Terms or your use of the Website.
10. Governing Law
These Terms and your use of the Website are governed by the laws of the People’s Republic of China. Any disputes shall be subject to the jurisdiction and procedures outlined in the Cruise Ticket Contract.
11. Modifications
We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting to the Website. Your continued use constitutes acceptance of the new Terms.
